Age and DACA

What is DACA?

Deferred Action for Childhood Arrivals (“DACA”) is a policy created and enacted by President Obama in 2012. Through the DACA program, children, who often otherwise had no control over their illegal immigrant status, could receive a renewable 2-year grace period without threat of deportation and with lawful employment.

Furthermore, there is no direct path from DACA to citizenship and it is not immigration status. This relief is not without several challenges to the applicant. Among several other requirements, the applicant must prove that she entered the United States before turning 16 years old.

How Can I Navigate a DACA?

This can prove quite a challenge. DACA eligible persons must generally have been born between 1981 and 1991. In the 1990s, anti-immigrant sentiment was high and came into fruition evidenced by deportation policy in the mid ‘90s. It was not in the best interest of illegal immigrant parents to leave a paper trail. Proving the age of the child at the time of entrance in to the United States is challenging, but not impossible.

Parents may, as some examples, furnish their rent receipts, utility bills, employment or tax records, or military records. School records such as transcripts or report cards of the immigrant child may also be produced. There are several other sources USCIS may take into consideration regarding this and all other elements the applicant is required to prove to request DACA.
