DACA & Executive Power
Information from a Dedicated Houston Immigration Lawyer
In 2012, the Obama Administration announced Deferred Action for Childhood
Arrivals, or DACA, a powerful program that allows certain young, undocumented
avoid deportation and even legally work here in the U.S. The program, which has helped hundreds
of thousands of individuals continue to build their lives in America,
has been generally unpopular with conservative lawmakers. Now, in the
2016 election year, there is real concern that, in the event of a GOP
presidency, DACA could become a thing of the past.
If you are interested in applying for DACA, then the next few months could
be crucial to securing its protections. At

Understanding DACA Eligibility
Not all undocumented non-citizens are eligible for DACA. The program is
meant to benefit those who arrived in the U.S. at a young age, have integrated
into our communities, and meet certain other legal criteria.
To be eligible for DACA, you must at least:
- Have arrived in the U.S. before the age of 16
- Have no lawful status on June 15, 2012
- Have continually lived in the U.S. since June 15, 2007
- Have completed high school, a GED program, military service, or be currently
enrolled in school
- Have not been convicted of a felony, significant misdemeanor or 3 or more
- Have been physically present in the U.S. on June 15, 2012
- Be physically present in the U.S. at the time of your application
- Must be over 15 at the time of applying, unless in removal proceedings
- And must be under 31 as of June 15, 2012
Meeting all these requirements does not guarantee being granted DACA protections.
There may be other considerations before applying for DACA, which is why
it is best to speak with a reputable Houston immigration lawyer. These
criteria may also change in the future. For more information on eligibility

Why Is DACA In Danger?
The GOP presidential nominee Donald Trump has infamously shared some controversial views on
immigration issues. He has proposed the construction of a 1,989-mile wall at the Mexican
border, a ban on Muslim immigration, and strict vetting of all incoming
immigrants. If elected to the Oval Office, it is likely that a candidate
like Mr. Trump would repeal prior executive orders like DACA.
Similarly, Republican leaders have resisted DACA, DACA expansions, and
the Deferred Action for Parents of Americans program (or DAPA). In summer
2016, the Supreme Court of the United States could not come to a majority
opinion on DAPA and from a 4 to 4 split decision has blocked its implementation
due to a lawsuit brought by Texas and other states against the federal
These are just some of the reasons why applying for DACA or DACA renewal
