Accountant Obtains TN Visa
The Modi Law Firm, PLLC recently assisted an individual in obtaining TN nonimmigrant status as an accountant. TN nonimmigrant status is only available to citizens of either Canada or Mexico who are seeking admission to the United States for temporary employment in certain professions. TN nonimmigrant status may be granted for an initial period of up to three years and may be renewed as long as the applicant continues to be employed in a qualifying profession and meets all other requirements. In order to obtain TN status, citizens of Mexico must apply for a visa at U.S. embassy or consulate. However, Canadian citizens may apply for TN status by presenting the required evidence at a Port-of-Entry or airport preclearance location. It is advised that individuals who are interested in applying for TN nonimmigrant status consult with an experienced immigration attorney.
Adjustment of Status Approved During Immigration Interview
The Modi Law Firm, PLLC recently got an I-485 application for adjustment
of status and I-130 petition for alien relative application approved during
the adjustment of status interview. The clients, a newly married couple,
retained our services shortly after getting married. Due to the extensive
supplemental documentation that we included in our clients’ packet,
the adjudicating officer was satisfied with all of the evidence provided
and approved the I-485/I-130 on the spot. Our client’s legal permanent
resident card (common referred as “green card”) was received
a few days after the interview.

Affirmative Asylum Approval

request for asylum was based on persecution on account of religion. Immigration

Against the Odds: Status Change Approved for Client Out of Status
At The Modi Law Firm, PLLC, we recently secured an unexpected and rare victory for a client who was attempting to change their immigration status under very challenging circumstances. This client was out of status when they applied to change from a work-based visa to a student visa, a situation that typically leads to denial. After nearly a decade of lawfully living and working in the U.S. on an employment-based visa, our client lost their employment and soon after attempted to transition to a student visa on their own. Unfortunately, their change of status application was filed just after the 60-day grace period following job termination, making the case extraordinarily difficult.
For most applicants, a late filing would result in a denial due to maintenance of status requirements. The client hired us to submit a detailed legal brief and response to the Request for Evidence (RFE) issued by USCIS. We argued that the filing should be deemed timely under existing USCIS policy and that USCIS should exercise its discretion to accept the filing.
In addition, we emphasized several critical points:
The client’s long-standing history of lawful presence in the United States
Their strong educational purpose and career goals
Evidence of their intent to depart the U.S. after completing their studies
Ties to their home country, including property ownership and financial connections
A pending immigrant visa petition with a non-current priority date, showing no current eligibility for permanent residence and thus no conflict with the F-1 status requirement of nonimmigrant intent.
We supported our arguments with updated documentation, including financial records, sworn declarations, and legal citations from the USCIS Policy Manual and relevant regulations. Despite the odds, USCIS approved the client’s change of status application. This means our client now has the legal ability to remain in the U.S. and pursue their education with their lawful status fully restored. This rare outcome is a testament to our team's detailed advocacy, creativity, and deep knowledge of immigration law and policy. This case reminds us that even when the chances feel slim, thoughtful legal strategy and strong documentation can make a real difference. An Olympic Approval
Our firm recently prepared an EB-1 immigrant visa petition on behalf of an Olympic medalist. The former Olympian sought classification as an Alien of Extraordinary Ability based upon the Olympic medal that she was previously awarded. This particular immigrant visa petition does not require a petitioning employer or family member; thus, one may self-petition if they meet the requirements. In order to qualify as an alien of extraordinary ability, one must be able to demonstrate extraordinary ability in the sciences arts, education, business, or athletics through sustained national or international acclaim. The petitioner must provide evidence of a one-tie achievement, such as a Nobel Prize, Oscar, Pulitzer, or Olympic Medal or, alternatively, demonstrate that they meet at least 3 of 10 criteria demonstrating extraordinary ability. Now that our client's EB-1 petition has been approved by USCIS, she may now apply for an immigrant visa at the U.S. Embassy in her country of citizenship.
