The K-1 process involves multiple government agencies and specific timelines that cannot be extended. Understanding what is required at each step helps you move through it without avoidable delays.
Who Qualifies for a K-1 Visa?
The K-1 visa is available to the foreign-national fiance of a U.S. citizen. Permanent residents cannot petition for a K-1 visa for their partners.
Both parties must be legally free to marry, meaning any prior marriages must have been legally terminated. You must also have met your fiance in person at least once in the two years before filing, unless a meeting would violate strict and long-established customs of your fiance's culture, or would cause extreme hardship.
Step 1: File Form I-129F
The process begins when the U.S. citizen files Form I-129F (Petition for Alien Fiance) with USCIS. This petition establishes the qualifying relationship and your intent to marry.
Along with the form, you will submit evidence of your U.S. citizenship, proof that you have met in person, evidence of your relationship (photos, communication records, travel records), and proof that any prior marriages have ended.
Step 2: National Visa Center and Consular Processing
Once USCIS approves the I-129F, the case is forwarded to the National Visa Center (NVC) and then to the U.S. consulate in your fiance's home country.
Your fiance will receive instructions to complete Form DS-160 (the online nonimmigrant visa application), gather required documents, and schedule an immigrant visa interview at the consulate.
Step 3: Medical Examination and Interview
Before the consular interview, your fiance must complete a medical examination with a USCIS-approved physician in their country. The exam covers vaccinations and general health requirements.
At the consular interview, a U.S. consular officer will review the application, ask questions about the relationship, and determine whether to approve the visa. Strong documentation of a genuine relationship is the most important factor in a successful interview.
Step 4: Enter the U.S. and Get Married Within 90 Days
If the K-1 visa is approved, your fiance has six months to use it to enter the United States. Once they arrive, you have exactly 90 days to get married.
This deadline is firm. If you do not marry within 90 days, your fiance must leave the country. There are no extensions.
Step 5: Apply for Adjustment of Status
After the marriage, your spouse can apply for a green card through adjustment of status by filing Form I-485. This converts their status from K-1 visa holder to conditional permanent resident.
After two years of conditional residence, you apply together to remove the conditions and receive a 10-year permanent resident card.
How Long Does the K-1 Visa Process Take?
The USCIS processing time for the I-129F petition alone currently runs between 6 and 12 months. After approval, consular processing adds additional time. In total, most K-1 cases take 12 to 18 months from start to entry.
