EB-5 Visa Requirements: What Investors Need to Know

The EB-5 Immigrant Investor Program offers a direct path to a U.S. green card through a qualifying investment in a commercial enterprise. It is one of the few immigration pathways that does not require a family member or employer to sponsor you.

If you are considering the EB-5 program, understanding the current requirements is essential. Investment thresholds, job creation rules, and the two available investment paths have all been updated in recent years.

What Is the EB-5 Visa?

The EB-5 visa is an employment-based, fifth preference immigrant visa. It grants conditional permanent residence to investors and their immediate family members (spouse and unmarried children under 21).

After two years, investors can apply to remove the conditions on their green card, which converts it to permanent status, provided the investment requirements have been met.

Minimum Investment Amounts

The minimum required investment depends on where the business is located. As of 2022, under the EB-5 Reform and Integrity Act, the standard minimum investment is $1,050,000.

Investments in a Targeted Employment Area (TEA) qualify for a reduced threshold of $800,000. A TEA is either a rural area or an area with high unemployment (at least 1.5 times the national average). TEA designation affects the investment amount, not the rest of the process.

Job Creation Requirements

Every EB-5 investment must create or preserve at least 10 full-time jobs for qualifying U.S. workers. This is a hard requirement with no exceptions.

For direct investments in a business, those jobs must be direct employees of the new commercial enterprise. For investments through a USCIS-designated Regional Center, the jobs can include indirect and induced employment calculated through economic models.

Two Investment Paths: Direct and Regional Center

A direct investment means you invest capital directly into a new commercial enterprise that you also manage or are involved in running. You are responsible for demonstrating that the business created the required jobs.

A Regional Center investment pools capital from multiple investors into a USCIS-designated project, typically in real estate development or infrastructure. Regional Centers handle job creation documentation, which makes this path more hands-off but requires careful due diligence on the Regional Center and its track record.

The Source of Funds Requirement

USCIS requires you to document that your investment funds came from a lawful source. This means tracing the money from its origin through every transfer until it reaches the EB-5 enterprise.

Common lawful sources include business income, salary, real estate sales, inheritance, and gifts. The documentation requirement is one of the most detailed parts of the EB-5 application, and inadequate source of funds documentation is a frequent reason for delays and requests for evidence.

How Long Does the EB-5 Process Take?

EB-5 processing times have historically been lengthy. Applicants from countries without significant backlog, including most of Europe, Latin America, and the Middle East, can expect the process to take between two and four years from petition filing to conditional green card approval.

Applicants born in China and India face substantially longer waits due to high demand relative to the annual visa allocation.

That said, not all EB-5 investments carry the same timeline. Certain project types, such as investments in rural areas or high-impact infrastructure projects, may qualify for priority processing or benefit from more favorable priority dates, which can meaningfully reduce wait times compared to standard Regional Center projects. Availability and eligibility depend on current USCIS policy and the specific project.
